New ��ýReport Maps Increasingly Complex Digital Public Library Ecosystem

WASHINGTON, D.C. — With a 34 percent increase in digital book borrowing since 2019, the size and scope of the digital content ecosystem for public libraries and patrons have made transparency more important than ever, according to a new report released today by the ��ý (ALA). Explaining the nuts-and-bolts of digital lending as well as the bigger picture, the Digital Public Library Ecosystem 2023 report will assist library and publishing professionals as they work to connect growing audiences to their preferred materials, in their preferred formats. Competition and innovation have improved patrons’ access to digital books through a diverse array of distributors, apps and library-enabled subscriptions.

Report authors Rachel Noorda, Ph.D, and Kathi Inman Berens, Ph.D., both professors of book publishing of Portland State University, show how the rise in digital content consumption rates has brought a large group of library patrons and staff into digital content landscape. The report demystifies licensing terms for digital books and explains why flexible licensing terms reduce patron wait times.

"This report is clarifying and simplifying for public library digital content stakeholders," said Dr. Noorda. "The report's long-term goal of is to facilitate collaboration between libraries, authors, publishers, distributors, and consumers. The first step toward that is defining key concepts and structures within the system."

According to the report, three key factors have contributed to confusion about the structure of and access to the digital public library ecosystem:

Essential terms like “reading,” “library use,” and “circulation” should be consistently and transparently defined.
The impact of current digital licensing terms on authors: midlist, bestselling, and self-published.
The role of Big Five publishers in setting licensing terms for public libraries.
How Amazon’s dominance in the audiobooks market influences audiobook library access, impacting audiobook authors, publishers, and narrators.
Gen Z and millennials borrow extensively from digital collections but are less aware that digital library lending apps are connected to their local library.

Noorda and Inman Berens point out that no individual entity created or caused the complexity within the current ecosystem, which is the result of multiple cycles of investment and innovation by both libraries and publishers. The report offers informed solutions and pathways to collaboration between all stakeholders.

"It will take the entire digital public library ecosystem – libraries, publishers and consumers alike – to solve the challenges and complexities we’re facing," said ��ýPresident Emily Drabinski. "This report is an important, solution-oriented step toward bringing together all stakeholders with a shared understanding of the current digital content landscape, its limitations, and its boundless opportunities."

With digital content consumption rates rising, the report also emphasizes the importance of flexible licensing terms for libraries and library consortia. Libraries have struggled to meet demand for digital content, with library budget constraints a key factor. Flexible terms allow libraries to maximize their digital collections budgets while also reducing wait time for patrons.

"As libraries face rising demand for digital content of all types, flexible licensing and contract terms would allow patrons to consume the media they want, when they want it, while enabling libraries to more evenly balance their budgets," said Dr. Inman Berens.

The report builds on earlier cohort-specific analysis the authors conducted in ALA’s previous report, Gen Z and Millennials: How They Use Public Libraries and Identify Through Media Use.

WASHINGTON--On February 16, 2022, the U.S. District Court for the District of Maryland granted a preliminary injunction of Maryland’s library digital book law in the case of Association of American Publishers v. Brian Frosh. The legislation, which went into effect on January 1, 2022, requires publishers who sell e-book licenses to Maryland consumers to also sell licenses to Maryland public libraries “on reasonable terms.” Court proceedings continue towards final adjudication of the complaint by the Association of American Publishers.

The ��ý (ALA) issued the following statement from ��ýPresident Patty Wong:

“The ��ý is disappointed that the court issued the preliminary injunction. Regardless of the legal technicalities, the proceedings thus far have established that there is a definite injustice in library access to digital books.*

“The Maryland legislature, which voted unanimously in favor of the legislation, rightly sees the unfairness in the marketplace and used its legal authority to correct it. ��ýsees the unfairness to our public libraries, which have paid for e-book licenses on unreasonable terms for far too long. Most importantly, libraries see the unfairness for Maryland residents, who rely on them for access to e-books.

“��ýunequivocally supports the Maryland law and stands by the Attorney General’s defense of Maryland libraries’ right to buy licenses for digital content on reasonable terms. We look forward to the next steps in this court proceeding toward the goal of equitable library access to digital books and fairness for all stakeholders in the publishing ecosystem.

“As always, libraries and library associations are willing and ready for discussions with rights holders—the publishers—and hope discussions may advance, irrespective of the legal directions or policy context.”

* During the hearing on the case, Judge Deborah L. Boardman stated, “It does seem to me that there is inequity and an unfairness on how publishers have treated public libraries.” In pleadings submitted prior to the hearing, Maryland Attorney General Brian E. Frosh stated, “Publishers capitalize on the digital revolution at libraries’ expense.”

WASHINGTON, DC — On Dec. 29, 2021, New York Governor Kathy Hochul vetoed legislation that would require publishers to offer licenses for electronic books to libraries under reasonable terms (S2890B / A5837B). The bills had passed the New York state senate and assembly with overwhelming bipartisan support in June 2021. ��ýPresident Patricia “Patty” Wong issued the following statement:

"Governor Hochul’s decision to veto S2890B / A5837B is unfortunate and disappointing. Protecting New Yorkers’ access to digital books through the library is critical to ensuring equitable access to information for all. We are grateful to the New York Library Association and New York library workers, advocates, and partners in the legislature who helped develop and champion this bill, and we will continue to work toward a solution that puts equitable access first."

The governor’s claim that federal law ties the hands of state lawmakers is incorrect in response to publishers' unreasonable attempts to discriminate against public libraries.

The problem is clear: For popular trade ebooks, libraries often pay $55 for one copy that expires after 2 years (or $550 for one copy for 20 years). Meanwhile, a consumer will pay about $15 for perpetual use. By comparison, libraries can purchase hardcover books for around $18-20. The challenges don’t end there: non-price terms are similarly problematic, such as the ability to archive and preserve works or develop versions for people with disabilities. From the library user’s perspective, change is necessary.

��ýwill continue active engagement toward more reasonable access to digital books for libraries. While direct negotiation with the industry – with whom most of the decision-making and authority on library digital book pricing and access rests – is preferred, ��ýwill also work at the state and federal levels to extend some of the rights that libraries have in the print world to the digital environment.

Too much power rests with publishing companies and their large multinational parents. ��ýfirmly believes libraries need to have more of a voice in the digital book market. America’s communities deserve to be heard and served through their libraries. Library groups, library advocates, and friends of libraries will not cease our efforts to ensure fair pricing for libraries despite this disappointing outcome.

CHICAGO - “The Need for Change: A Position Paper on E-Lending by the ��ýJoint Digital Content Working Group” examines digital lending in public, academic, and K-12 school libraries. The paper notes current and long-standing challenges in digital content lending and the issues that complicate acquisition of, user access to, and preservation of digital information.

The pandemic continues to fuel increased demand for digital content and has highlighted the importance of digital media within U.S. libraries. According to OverDrive, a leading provider of digital library content, in 2020, readers worldwide borrowed more than 430 million ebooks, audiobooks, and digital magazines, an increase of 33% compared with 2019 figures.

As patrons continue to discover and rely on digital content, libraries continue their fight for fair pricing, multiple licensing models, and full access to digital content.

Current publisher licensing models impede library purchases and create information barriers that leave patrons who depend on digital library collections for education and enrichment with long waits or, worse yet, searches that yield no results.

Publishers’ limited licensing models are not the only barriers impeding robust collections. The paper also identifies issues with content provider platforms that cannot support multiple license models simultaneously, even if publishers offer options.

“If we don’t modify current problematic licensing and delivery models, libraries of all types will struggle to meet an ever-increasing demand for digital materials,” said Kelvin Watson, co-chair of the ��ýJoint Digital Content Working Group. “Existing license models are not sustainable for libraries. Library users are being excluded from reading as surely by those models as they are by the physical barriers to borrowing created by the pandemic.”

The paper serves as a call to action for publishers to offer licensing models that are cost-effective and flexible and for library digital content providers to revamp platforms to support flexible licensing models, robust collections and enhance accessibility features.

CHICAGO – Today, the Public Library Association (PLA) announced two additional webinars to take place in December.

The first, #eBooksForAll Campaign Update, will be held Tuesday, Dec. 17, from 1–2 p.m. Central Time. Presented by PLA and the ��ý (ALA) Public Policy & Advocacy Office, this webinar is intended to provide the latest information on the #eBooksForAll campaign against Macmillan Publishers' harmful new library eBook lending model. A panel of experts will provide an update on ALA's advocacy and data-gathering efforts. They will also discuss specific actions library supporters can take to advance this important cause. The second, Applying Trauma-Informed Concepts to Reduce Harm, will be held Wednesday, Dec. 18, from 1–2 p.m. Central Time. ��ýturns to Congress as Macmillan ignores public call to reverse library e-book embargo

WASHINGTON—Today Macmillan Publishers begins to limit access to e-books through America’s libraries by instituting an eight-week embargo on library e-book purchases. Despite robust public demand to reverse the policy, the publisher is moving ahead with its plan to limit sales to public libraries. Regardless the size of the library – from large library systems in Washington State and rural libraries in Rhode Island to entire statewide consortiums of small libraries such as in Wisconsin – Macmillan will sell only one copy of a new e-book title for the first two months after release.

On Wednesday, the ��ý (ALA), with the Public Library Association (PLA) and other local and national allies, delivered nearly 160,000 petition signatures from all 50 states and Canada demanding fair and equitable access to digital content,” said ��ýPresident Wanda Brown. “We want a fair path forward for readers, libraries, authors and publishers. ��ýurged the publisher to suspend the embargo, but Macmillan is determined to go through with the new policy.”

"On behalf of the Public Library Association and our diverse members across the country working to serve millions of Americans every day, I am disappointed and extremely upset Macmillan has ignored our collective voices," said PLA President Ramiro Salazar. “As we informed Macmillan CEO John Sargent and all of our members, we will continue to advocate and fight on multiple fronts for fair prices and terms that enable public libraries to meet our mission of ensuring equitable access to information and resources for all.”

In response to Macmillan’s decision, ��ýwill continue to collect signatures of those who oppose the embargo on ebooksforall.org and gather stories about how the e-book embargo is impacting communities. In addition to the public awareness campaign, ��ýwill deepen engagement with lawmakers on Capitol Hill.

On October 24, the ��ýreleased a report responding to an inquiry from the U.S. House of Representatives Committee on the Judiciary Subcommittee on Antitrust, Commercial and Administrative Law that denounces embargoes by companies like Macmillan and Amazon, who refuses to sell any of its published content to libraries. Such restrictions threaten Americans’ right to read what and how they choose and imperil other fundamental First Amendment freedoms, the report said.

“We had hoped to take Mr. Sargent at his word that he is open to admitting error in being the sole major U.S. publisher to block library e-book purchases,” said Alan Inouye, ALA’s senior director of public policy and government relations and one of ALA’s lead negotiators with publishers on library access to digital content. “Now we will turn our full attention to Congress and other policymakers at the national and state levels to right this wrong.”

Library leaders, publishers meet to discuss growing opposition to library e-book embargo as Congress undertakes inquiry

NEW YORK – Today ��ý (ALA) leaders, members and supporters delivered a petition with nearly 160,000 signatures to Macmillan Publishers CEO John Sargent, urging him to reverse the new policy that will limit libraries’ access to e-books. Signed by readers, authors, library staff and patrons from all 50 states, the #eBooksForAll petition demands that library access to e-books not be delayed or denied.

��ýPresident Wanda Brown said, "The mission of public libraries across the country is to ensure access to information and content for all, but Macmillan’s e-book restrictions will drastically restrict our ability to serve millions of readers. Libraries, publishers and authors should be allies - not adversaries - in expanding the number of readers and encouraging the exploration of new titles and subjects.”

Hours before ALA’s planned petition delivery and meeting with Macmillan leaders, Sargent issued a letter to librarians. The letter, Sargent’s first direct communication with libraries about the embargo since it was announced in July 2019, misrepresents ALA’s longstanding and good-faith efforts to equitably balance the rights and privileges of readers, libraries, authors, and publishers.

“Macmillan remains the sole Big 5 publisher that perceives a business need to limit libraries’ ability to purchase and lend eBooks,” said Alan Inouye, ALA’s senior director of public policy and government relations and one of ALA’s lead negotiators with publishers on library access to digital content. “��ýhas frequently requested but never received data or analysis that demonstrates that library lending undermines book sales. It is simply false to state otherwise.”

When the new policy goes into effect November 1, the publisher will limit library purchases to only one copy of each new e-book title for the first eight weeks after its release. Additional copies will then be available for two years of access at a cost that is often more than quadruple consumer prices.

“Libraries want to provide readers with a range of options that will inform, educate and enlighten,” said Ramiro S. Salazar, president of the Public Library Association (PLA), a division of ALA, and director of the San Antonio Public Library. ”As demand for digital content grows, we cannot idly accept Macmillan’s new e-book policy. Offering only one new e-book in San Antonio, for a library serving almost 2 million people at 30 locations, will deny timely access, extend patron wait times to the extreme and discourage readership.”

Joining Inouye to deliver the petition were PLA Executive Director Barb Macikas, Loida Garcia-Febo, ��ýImmediate Past President; Sari Feldman, ��ýpolicy fellow and past ��ýpresident; Tim Cherubini, executive director, Chief Officers of State Library Agencies (COSLA); Caroline Ashby, director, Nassau Library System; and Angie Miraflor, director of customer experience at Brooklyn Public Library. Launched on September 11, 2019, the petition has attracted signatories from across the US and Canada, with the most signatures coming from Ohio, Oregon, Texas, New York and California.

According to a new report publicly released on October 24 by ALA, current practices by content publishers and distributors in digital markets limit libraries’ ability to deliver core services. The ��ýreport, submitted in response to an inquiry from the U.S. House of Representatives Committee on the Judiciary Subcommittee on Antitrust, Commercial and Administrative Law, calls out embargos by companies like Macmillan Publishers as well as Amazon, who refuses to sell any of its published content to libraries. Such restrictions threaten Americans’ right to read what and how they choose and imperil other fundamental First Amendment freedoms.

The report addresses publishers’ abusive pricing and restrictive licensing terms for libraries. Over the past 10 years, libraries have spent more than $40 billion acquiring e-books, as well as streaming music and audiovisual content from publishers. For popular e-book titles, libraries pay up to five times the consumer list price and, unlike the individual, libraries typically have access to an e-book title for only two years.

“If John Sargent cannot or will not hear us, we will continue to take action with our community leaders and patrons, with Congress, with state legislators and attorneys general, and with publishers and authors who view libraries as allies rather than adversaries,” Brown concluded.
