Explaining the nuts-and-bolts of digital lending as well as the bigger picture, the <a href="/sites/default/files/advocacy/content/ebooks/Digital-PL-Ecosystem-Report%20%281%29.pdf">Digital Public Library Ecosystem 2023</a> report will assist library and publishing professionals as they work to connect growing audiences to their preferred materials, in their preferred formats. Competition and innovation have improved patrons鈥 access to digital books through a diverse array of distributors, apps and library-enabled subscriptions. </p> <p>Report authors Rachel Noorda, Ph.D, and Kathi Inman Berens, Ph.D., both professors of book publishing of Portland State University, show how the rise in digital content consumption rates has brought a large group of library patrons and staff into digital content landscape. The report demystifies licensing terms for digital books and explains why flexible licensing terms reduce patron wait times. </p> <p>"This report is clarifying and simplifying for public library digital content stakeholders," said Dr. Noorda. "The report's long-term goal of is to facilitate collaboration between libraries, authors, publishers, distributors, and consumers. The first step toward that is defining key concepts and structures within the system."</p> <p>According to the report, three key factors have contributed to confusion about the structure of and access to the digital public library ecosystem: </p> <ul> <li>Essential terms like 鈥渞eading,鈥 鈥渓ibrary use,鈥 and 鈥渃irculation鈥 should be consistently and transparently defined. </li> <li>The impact of current digital licensing terms on authors: midlist, bestselling, and self-published. </li> <li>The role of Big Five publishers in setting licensing terms for public libraries. </li> <li>How Amazon鈥檚 dominance in the audiobooks market influences audiobook library access, impacting audiobook authors, publishers, and narrators. </li> <li>Gen Z and millennials borrow extensively from digital collections but are less aware that digital library lending apps are connected to their local library. </li> </ul> <p>Noorda and Inman Berens point out that no individual entity created or caused the complexity within the current ecosystem, which is the result of multiple cycles of investment and innovation by both libraries and publishers. Brian Frosh. The legislation, which went into effect on January 1, 2022, requires publishers who sell e-book licenses to Maryland consumers to also sell licenses to Maryland public libraries 鈥渙n reasonable terms.鈥 Court proceedings continue towards final adjudication of the complaint by the Association of American Publishers.</p> <p>The 精东传媒 (ALA) issued the following statement from 精东传媒President Patty Wong:</p> <p>鈥淭he 精东传媒 is disappointed that the court issued the preliminary injunction. The bills had passed the New York state senate and assembly with overwhelming bipartisan support in June 2021. 精东传媒President Patricia 鈥淧atty鈥 Wong issued the following statement: </p> <p>"Governor Hochul鈥檚 decision to veto S2890B / A5837B is unfortunate and disappointing. Protecting New鈥痀orkers鈥 access to digital books through the library is critical to ensuring equitable access to information鈥痜or all. We are grateful to the New York Library Association and New York library workers, advocates,鈥痑nd partners in the legislature who helped develop and champion this bill, and we will continue to work鈥痶oward a solution that puts equitable access first."</p> <p>The governor鈥檚 claim that federal law ties the hands of state lawmakers is incorrect in response to publishers' unreasonable attempts to discriminate against public libraries. </p> <p>The problem is clear: For popular trade ebooks, libraries often pay $55 for one copy that expires after 2 years (or $550 for one copy for 20 years). Meanwhile, a consumer will pay about $15 for perpetual use. By comparison, libraries can purchase hardcover books for around $18-20. The challenges don鈥檛 end there: non-price terms are similarly problematic, such as the ability to archive and preserve works or develop versions for people with disabilities. From the library user鈥檚 perspective, change is necessary. </p> <p>精东传媒will continue active engagement toward more reasonable access to digital books for libraries. While direct negotiation with the industry 鈥 with whom most of the decision-making and authority on library digital book pricing and access rests 鈥 is preferred, 精东传媒will also work at the state and federal levels to extend some of the rights that libraries have in the print world to the digital environment. </p> <p>Too much power rests with publishing companies and their large multinational parents. 精东传媒firmly believes libraries need to have more of a voice in the digital book market. The paper notes current and long-standing challenges in digital content lending and the issues that complicate acquisition of, user access to, and preservation of digital information.</p> <p>The pandemic continues to fuel increased demand for digital content and has highlighted the importance of digital media within U.S. libraries. According to <a href="https://company.overdrive.com/2021/01/07/33-growth-for-digital-books-from-public-libraries-and-schools-in-2020-sets-records/" target="_blank">OverDrive</a>, a leading provider of digital library content, in 2020, readers worldwide borrowed more than 430 million ebooks, audiobooks, and digital magazines, an increase of 33% compared with 2019 figures. </p> <p>As patrons continue to discover and rely on digital content, libraries continue their fight for fair pricing, multiple licensing models, and full access to digital content.</p> <p>Current publisher licensing models impede library purchases and create information barriers that leave patrons who depend on digital library collections for education and enrichment with long waits or, worse yet, searches that yield no results.</p> <p>Publishers鈥 limited licensing models are not the only barriers impeding robust collections. The paper also identifies issues with content provider platforms that cannot support multiple license models simultaneously, even if publishers offer options. </p> <p>鈥淚f we don鈥檛 modify current problematic licensing and delivery models, libraries of all types will struggle to meet an ever-increasing demand for digital materials,鈥 said Kelvin Watson, co-chair of the 精东传媒Joint Digital Content Working Group. 鈥淓xisting license models are not sustainable for libraries. Despite robust public demand to reverse the policy, the publisher is moving ahead with its plan to limit sales to public libraries. Regardless the size of the library 鈥 from large library systems in Washington State and rural libraries in Rhode Island to entire statewide consortiums of small libraries such as in Wisconsin 鈥 Macmillan will sell only one copy of a new e-book title for the first two months after release.</p> <p>On Wednesday, the 精东传媒 (ALA), with the Public Library Association (PLA) and other local and national allies, <a href="http://www.ala.org/news/press-releases/2019/10/ala-delivers-ebooksforall-petition-160000-signatures-macmillan-publishers">delivered</a> nearly 160,000 petition signatures from all 50 states and Canada demanding fair and equitable access to digital content,鈥 said 精东传媒President Wanda Brown. 鈥淲e want a fair path forward for readers, libraries, authors and publishers. 精东传媒urged the publisher to suspend the embargo, but Macmillan is determined to go through with the new policy.鈥</p> <p>"On behalf of the Public Library Association and our diverse members across the country working to serve millions of Americans every day, I am disappointed and extremely upset Macmillan has ignored our collective voices," said PLA President Ramiro Salazar. 鈥淎s we informed Macmillan CEO John Sargent and all of our members, we will continue to advocate and fight on multiple fronts for fair prices and terms that enable public libraries to meet our mission of ensuring equitable access to information and resources for all.鈥</p> <p>In response to Macmillan鈥檚 decision, 精东传媒will continue to collect signatures of those who oppose the embargo on <a href="https://ebooksforall.org/index.php/get-involved/">ebooksforall.org</a> and gather stories about how the e-book embargo is impacting communities. Signed by readers, authors, library staff and patrons from all 50 states, the #eBooksForAll petition demands that library access to e-books not be delayed or denied. </p> <p>精东传媒President Wanda Brown said, "The mission of public libraries across the country is to ensure access to information and content for all, but Macmillan鈥檚 e-book restrictions will drastically restrict our ability to serve millions of readers. Libraries, publishers and authors should be allies - not adversaries - in expanding the number of readers and encouraging the exploration of new titles and subjects.鈥</p> <p>Hours before ALA鈥檚 planned petition delivery and meeting with Macmillan leaders, Sargent issued a letter to librarians. The letter, Sargent鈥檚 first direct communication with libraries about the embargo since it was announced in July 2019, misrepresents ALA鈥檚 longstanding and good-faith efforts to equitably balance the rights and privileges of readers, libraries, authors, and publishers.</p> <p>鈥淢acmillan remains the sole Big 5 publisher that perceives a business need to limit libraries鈥 ability to purchase and lend eBooks,鈥 said Alan Inouye, ALA鈥檚 senior director of public policy and government relations and one of ALA鈥檚 lead negotiators with publishers on library access to digital content. 鈥溇絟as frequently requested but never received data or analysis that demonstrates that library lending undermines book sales. It is simply false to state otherwise.鈥</p> <p>When the new policy goes into effect November 1, the publisher will limit library purchases to only one copy of each new e-book title for the first eight weeks after its release. Additional copies will then be available for two years of access at a cost that is often more than quadruple consumer prices.</p> <p>鈥淟ibraries want to provide readers with a range of options that will inform, educate and enlighten,鈥 said Ramiro S. Salazar, president of the Public Library Association (PLA), a division of ALA, and director of the San Antonio Public Library. 鈥滱s demand for digital content grows, we cannot idly accept Macmillan鈥檚 new e-book policy. Offering only one new e-book in San Antonio, for a library serving almost 2 million people at 30 locations, will deny timely access, extend patron wait times to the extreme and discourage readership.鈥</p> <p>Joining Inouye to deliver the petition were PLA Executive Director Barb Macikas, Loida Garcia-Febo, 精东传媒Immediate Past President; Sari Feldman, 精东传媒policy fellow and past 精东传媒president; Tim Cherubini, executive director, Chief Officers of State Library Agencies (COSLA); Caroline Ashby, director, Nassau Library System; and Angie Miraflor, director of customer experience at Brooklyn Public Library.
